These Terms and Conditions govern the use of the services provided through the Miquel Supermercat website, www.miquelsupermercat.com, owned by ALIMENTÀRIA DEL MIGJORN, SL, hereinafter referred to as Miquel Supermercat, with registered office at Calle Ramon i Cajal, 5, 07638 Colònia de Sant Jordi, registered with the Commercial Registry of Mallorca, Volume 1999, Folio 37, Page PM-44583, and holder of Tax Identification Number B-57221954.
Use of the Miquel Supermercat website grants the status of user of the Miquel Supermercat website, hereinafter referred to as the “User”, and implies the User’s full and unconditional acceptance of each and every one of these Terms and Conditions, in the version published by Miquel Supermercat at the time the User accesses the Miquel Supermercat website, as these Terms and Conditions may be subject to change.
For this reason, the User must carefully read the content of these Terms and Conditions each time they intend to use the Miquel Supermercat website.
In all cases, the Terms and Conditions displayed on the Miquel Supermercat website at the time the User makes use of the services provided by Miquel Supermercat through the Miquel Supermercat website shall be deemed valid and applicable.
Access to and/or use of such services and content constitutes the User’s full and unconditional acceptance of the Terms and Conditions in the version published by Miquel Supermercat on its website at the time such access and/or use takes place.
The User declares that they are of legal age and have sufficient legal capacity to be bound by these Terms and Conditions and that they have read and understood their content.
Likewise, the User expressly and without exception accepts that access to and use of this website and its content is carried out under their sole and exclusive responsibility.
Conditions of Access and Use of the Website
The User must register by completing the corresponding form and will receive an identifying username and password. These are personal and non-transferable and will allow the User to enter into the purchase of products of interest with Miquel Supermercat.
Registration as a customer is free of charge.
The registered User undertakes to use the username and password diligently and to keep them confidential.
The User shall be responsible for any expenses, losses and damages caused by the use of the services by any third party using the User’s username and password as a result of negligent use or loss of such credentials by the User.

The same customer may have different delivery addresses associated with the same user account.
Likewise, there may be more than one User associated with the same delivery address where such Users do not reside at the property during the same period of time.
Promotions
Users shall receive a 10% discount on their first purchase, as well as free delivery regardless of the order amount.
Miquel Supermercat reserves the right to cancel discounts where fraudulent or improper use of the discount generation system is detected.
The use of different email accounts belonging to the same person for different orders shall be considered, among other cases, fraudulent or improper use of the discount system.
In all cases, Miquel Supermercat reserves the right to cancel orders resulting from fraudulent use of the discount system. In such cases, the amount paid for the cancelled purchase shall be refunded.
The User undertakes to use the Miquel Supermercat website in accordance with the law, these Terms and Conditions, morality, generally accepted standards of good conduct, public order and generally accepted practices, and agrees not to use the website www.miquelsupermercat.com for unlawful purposes or effects.
The User shall be liable for any loss or damage of any kind suffered by Miquel Supermercat as a result of the User’s failure to comply with any of the obligations arising under these Terms and Conditions.

Shipping is free of charge (€0) for the urban areas of ses Salines, Colònia de Sant Jordi, Campos, Santanyí, es Llombards, son Moja and Cala Llombards, with postal codes 07640, 07638, 07630, 07650 and 07690.
For the urban areas of Cala Santanyí, Cala Figuera, sa Torre Nova, ses Covetes, sa Ràpita, s’Estanyol de Migjorn, Son Bieló, el Paraíso, Cala Pi, Vallgornera, Tolleric and sa Vinyola, with postal codes 07659 and 07639, shipping is free of charge (€0) for purchases of €90.00 or more.
For purchases below this amount, shipping costs shall be €5.00.
For the urban areas of s’Alqueria Blanca, Portopetro, Barca Trencada, sa Teulera, Cala d’Or, s’Horta, Calonge, Cala Serena, Cala Ferrera, Felantix, Cas Concos, es Carritxo, son Negre, son Valls, son Mesquida, Portocolom, Porreres, Llucmajor, Cala Blava, sa Torre, Puigderrós, s’Arenal, Son Verí Nou, es Pil·larí, ses Cadenes, Can Pastilla, es Pinaret, l’Hostalot, son Ferriol and Palma, with postal codes 07691, 07660, 07669, 07200, 07208, 07209, 07670, 07260, 07620, 07609, 07600, 07610, 07198, 07001, 07002, 07003, 07004, 07005, 07006, 07008, 07009, 07010, 07011, 07012, 07013, 07014 and 07015, shipping is free of charge (€0) for purchases of €180.00 or more.
For purchases between €90.00 and €179.99, shipping costs shall be €4.00.
For purchases below €90.00, shipping costs shall be €8.00.
Users may place all their orders through the website www.miquelsupermercat.com.
Each Miquel Supermercat User declares that they have full legal capacity to use credit cards and confirms that the cards used have sufficient funds to cover all costs arising from the purchase of products through Miquel Supermercat.
By clicking the “Pay” button during the purchase process, the User declares that they fully and unconditionally accept all of these Terms and Conditions.
The data recorded by Miquel Supermercat shall constitute proof of the transactions carried out between www.miquelsupermercat.com and Users.
Miquel Supermercat shall confirm the order by email.
For this reason, and for security purposes, the creation of user accounts on Miquel Supermercat using temporary email services such as Spamgourmet, 10minutemail, Jetable, Yopmail, Mailcatch, Guerrillamail and similar services is not permitted.
Contractual information is provided in Spanish.
Availability
Miquel Supermercat shall make every effort to meet the demand of all Users for the products offered.
If a product is unavailable after an order has been placed, the User shall be informed either by email or by telephone using the number registered by the User.
The User shall be given the option either to cancel the entire order or to modify it, including the corresponding purchase amount.
In such cases, the speed at which the refund is credited to the customer’s bank account shall depend on the type of card used for the purchase and the conditions applied by the relevant banking institution.
Payment
Purchases are paid for by bank card.
The accepted bank cards are Visa, MasterCard and American Express.
If the Point of Sale Terminal reports that the card has been declined, the order shall be automatically cancelled.
Security
For security purposes, Miquel Supermercat has entrusted credit card payments to a payment gateway.
The bank details entered are encrypted and securely transmitted to the servers of the banking institution and are subsequently verified with the issuing bank in order to prevent possible fraud and misuse.
This data entry procedure is protected by 128-bit SSL encryption technology, one of the most advanced and effective protection systems currently available.
As a result, no third party shall have access via the Internet to the banking information entered by the customer.
Only the Bank, CajaMar, has access to the banking information associated with these payment methods.
Therefore, Miquel Supermercat does not know or record such data during the payment transaction or at any other time.
Delivery
Miquel Supermercat shall make every effort to deliver orders within the time frame and under the conditions specified during the purchase process.
The User shall select the delivery time according to service availability for their postal code. The available options may include:
Same-day delivery for orders placed before 12:00 noon.
Delivery on a specific date and at a specific time, which may be selected from the day following the purchase date onwards.
Click&Car service. The User shall receive an email or text message on their mobile phone when the order is ready and may collect it from our premises.
Yacht Provisioning service at the ports of Colònia de Sant Jordi, sa Ràpita and s’Estanyol. The User shall agree on a delivery date and time, as well as the port where the order will be collected.
Users may place orders up to a maximum of 15 days in advance.
Each time an order is to be dispatched, the buyer shall receive an email after payment has been made.
The purchase order corresponding to the order shall be available through Miquel Supermercat once payment has been confirmed and the confirmation email has been issued.
The original purchase order includes VAT.
Miquel Supermercat shall ask the User to select the delivery location.
The User must specify their home, office or other location where they wish the product to be delivered, as well as a contact telephone number in case any delivery issue arises.
Each delivery shall be deemed completed once the carrier makes the product available to the customer at the location specified by the customer for delivery when placing the order.
Reservations and complaints must be submitted to Miquel Supermercat by email at info@miquelsupermercat.
If your package arrives broken, wet, resealed or you believe its contents may be damaged, it is important that you record this on the carrier’s delivery note at the time of delivery and notify us of the incident within 24 hours of receipt of the goods by email at info@miquelsupermercat or by calling 971 65 50 43.
In such cases, Miquel Supermercat shall refund or replace products affected by damage or incidents occurring during transport, including, for example, loss of the goods.
Invoicing
You may request an invoice during the payment process.
To do so, simply select the “I want an invoice” option when choosing the delivery method for your purchase.
Once the invoice has been requested and the purchase delivered, you shall receive an email with the invoice attached.
If you forget to request it during the purchase process, you may request an invoice by email no later than the 16th day of the month following the month in which the purchase was made, in accordance with Royal Decree 1496/2003.

Returns
The products offered on www.miquelsupermerat.com are backed by leading commercial brands.
Providing the highest quality and the best possible guarantee is our commitment to our customers.
If the User is not satisfied upon receiving an order, they have a period of seven (7) calendar days from the date of receipt to exercise their right of return.
If the reason for the return is an error made by Miquel Supermercat, for example, the product is defective or it is not the product ordered, Miquel Supermercat shall bear the collection costs.
If the reason is different and the products were supplied correctly but are not to your satisfaction, Miquel Supermercat shall refund the cost of the products, excluding the return costs, which shall be borne by the customer.
In other words, where the products have been supplied correctly but are not to the customer’s satisfaction and are returned within the established period of 7 calendar days from receipt of the product, Miquel Supermercat shall refund the cost of the products, excluding the return costs, which shall be borne by the customer.
If Miquel Supermercat is due to make a delivery at a location and during a time slot previously agreed and confirmed by the customer, in accordance with these Terms and Conditions, and the customer is not present at that location during the agreed time slot, hereinafter referred to as an “unreported absence”, Miquel Supermercat reserves the unilateral right to refund the purchase amount to the customer, after deducting in all cases any costs incurred as a result of transport and/or preparation of the order, as well as return costs.
Delivery costs shall amount to €5.00 for each journey made to the address indicated by the customer.
Return costs arising from an “unreported absence” shall be the same as those applicable in the situation described in the previous paragraph.
If Miquel Supermercat fails to make the delivery at the location and during the time slot previously agreed and confirmed by the customer, the customer may unilaterally refuse the order and Miquel Supermercat shall refund the amount actually paid for the purchase.
Miquel Supermercat shall only accept returns that meet the following requirements:
The product must be in the same condition in which it was delivered and, insofar as possible, must retain its original packaging and labelling.
The return must be made using the same box or packaging in which the order was delivered or, failing that, packaging of a similar nature that ensures the goods are returned in perfect condition.
A copy of the delivery note must be included inside the package, with the returned products clearly indicated.

Goods to be returned must, in all cases, be unused, except as provided for in Article 79 of Royal Legislative Decree 1/2007 of 16 November.
In accordance with applicable law, specifically Article 103 of Royal Legislative Decree 1/2007 of 16 November, the above shall not apply, among other cases, to:
Goods that are liable to deteriorate or expire rapidly, as well as products that have been opened and/or partially consumed.
Sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery.
Goods which, after delivery and due to their nature, have become inseparably mixed with other goods.
Warranty
Warranties and after-sales services shall be governed by Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users.
Under this legislation, the seller is required to deliver products to the consumer and user that conform to the contract and shall be liable for any lack of conformity.
The consumer and user shall be entitled to have the product repaired or replaced, to receive a price reduction, or to terminate the contract.
The statutory periods are two years of warranty from delivery of the product and two months from the date on which the User becomes aware of the lack of conformity to notify the seller.
Liability, Disputes and Applicable Law
Miquel Supermercat shall not be held liable for failure to perform the contract in the event of stock shortages, force majeure, disruption or total or partial strikes, particularly affecting postal services, transport and/or communications, flooding, fire or similar events, without prejudice to refunding the customer the purchase amount actually paid.
These Terms and Conditions are governed by Spanish law.
In the event of a dispute, the User shall first contact Miquel Supermercat in an attempt to reach an amicable solution.
These general conditions of sale shall be interpreted in Spanish and governed by Spanish law.
Any dispute that may arise regarding their validity, interpretation or performance shall be submitted to the courts of the customer’s place of residence, which are expressly granted exclusive jurisdiction.
These General Conditions are governed by Spanish law.
For the resolution of disputes, the parties submit, at their choice and waiving any other jurisdiction, to the courts and tribunals of the User’s place of residence.
The European Commission also provides consumers in the European Union with an online dispute resolution platform for the amicable resolution of disputes, in accordance with Article 14(1) of Regulation (EU) No 524/2013, available at http://ec.europa.eu/odr.
These Terms and Conditions shall be interpreted in Spanish.
Modification of the General Conditions of Sale
Miquel Supermercat reserves the right to modify these Terms and Conditions without prior notice.
It may change, remove or add content and services provided through the website, as well as modify the way in which they are presented or located on its servers.
Such changes must be accepted by the User each time a purchase is made through the Miquel Supermercat website.
Users of Miquel Supermercat who do not agree with modifications to the Terms and Conditions must notify Miquel Supermercat and, from the date on which the new version enters into force, must stop using the Miquel Supermercat services.
If any provision contained in these Terms and Conditions is declared wholly or partially null, invalid or unenforceable, such nullity, invalidity or unenforceability shall affect only that provision or the part thereof that is affected.
The remaining Terms and Conditions shall remain fully valid and effective, and the affected provision or part thereof shall be deemed not to have been included.
